1. Driving tuition

1.1. All ELITE driving instructors are self-employed and operate as ELITE Driving School under a franchise with ELITE Driving Instructor Training Ltd. ('ELITE').

1.2. The instructor shall provide the pupil with driving tuition at the rate communicated on the ELITE website www.elitelessons.co.uk. Most driving lessons are scheduled to last two hours, although other durations can be arranged between the pupil and the individual instructor.

1.3. To provide consistency and continuity, after the first lesson all lesson bookings should be made directly between the pupil and allocated instructor.

1.4. If due to unforeseeable circumstances the normal instructor is unavailable for any reason to provide an arranged lesson, the instructor has the right to arrange an alternative date or for another instructor to provide some or all of the pupil's driving tuition.

1.5. If ELITE are unable to provide an alternative instructor due to such circumstances then a full refund of any pre payment shall be honoured.

1.6. The instructor will supply a dual controlled vehicle which will carry the appropriate motor insurance should you cause an accident as a learner whilst driving the instructor's tuition vehicle, whether the pupil is accompanied by an instructor or a Driving Standards Agency Examiner.

2. Pupil Requirements

2.1. To take on-road driving lessons, it is the pupil's responsibility to ensure that they have the required licence to drive under the tuition of an instructor in the UK.

2.2. To take driving lessons in a motor vehicle on the public highway, an individual must be at least 17 years of age and hold a valid provisional driving licence.

2.3. The pupil will be asked by the instructor to show both parts (photo card and counterpart) of their provisional licence (if a learner), or both parts (photo and counterpart) of their full driving licence (if taking refresher, motorway or pass plus lessons) at the start of the first driving lesson.

2.4. The pupil will disclose to the instructor any current or outstanding penalty points, driving convictions or court hearings that my affect the individuals right to drive.

2.5. The pupil will be required to read a standard size number plate (with glasses or corrective lenses if necessary) from 20.5 metres (67 feet) or 20 metres (65 feet) where narrower characters (50 millimetres wide) are displayed. This requirement is specified in law and any person driving on a public highway who is unable to do this is guilty of an offence. Failure to achieve this on the first lesson will result on no driving taking place or forfeit of the lesson.

3. Initial Booking procedure

3.1. An initial provisional booking will be made in an instructors diary over the telephone by the ELITE customer service team.

3.2. This booking is made subject to confirmation of availability from the individual instructor to the ELITE customer service team.

3.3. Once this confirmation has been received a confirmation text message or email stating date and time of booking will be sent to the customer within 24 hours of the booking.

3.4. If the initial booking can not be fulfilled then the customer will be contacted by either the ELITE Customer Service team or directly by the instructor within 24 hours of the booking being made, and an alternative date arranged.

4. Payments

4.1. The Pupil must pay for each lesson in advance.

4.2. Payment for the current or next lesson can normally be made direct to the instructor, but these can also be made to the instructor's agent ELITE (ELITE Driving Instructor Training Ltd.) by most major credit or debit cards via our Head Office on 020 8781 1818 or in person at a pre agreed time.

4.3. Debit cards are processed free of charge. There will be an additional 3% processing fee added by CREDIT card.

4.4. Any fees for driving tests will not be accepted by ELITE or your instructor and should be made directly to the Driving Standards Agency (DSA).

4.5. Where payments are made directly to the instructor, they should be made by cash or cheque made payable directly to the instructor.

4.6. ELITE do not accept any responsibility whatsoever for any acts, default or failure on the part of the instructor not to carry out their obligations.

4.7. Any payments made by credit / debit card will be processed by ELITE (ELITE Driving Instructor Training Ltd.) and the full amount credited directly to your instructor 48 hours before the first lesson, upon which ELITE Driving Instructor Training Ltd will not accept responsibility for any acts, default or failure on the part of the instructor not to carry out their obligations.

4.8. Any advance payments made for lessons are made on the understanding that those lessons will be taken within 3 months of the payment being accepted.

4.9. Pupils must give the instructor, directly by the means of a telephone call, at least two working days' notice (a working day being Monday to Friday inclusive) if a pupil wishes to cancel a driving lesson, otherwise the pupil will still be liable for the lesson fee in respect to that lesson. If a pupil wishes to cancel the first lesson they have booked this must be done directly to the ELITE head office on 020 8781 1818.

4.10. If an initial lesson is cancelled with more that 48 hours notice then any advance payment received will be either held in credit towards future lessons or a full refund issued to the purchasers card upon request.

4.11. ELITE Driving Instructor Training Ltd do not hold any payment card details on record.

5. Gift vouchers

5.1. In addition to the terms below, normal terms and conditions as stated above apply to the purchase of gift vouchers and booking of lessons.

5.2. Gift vouchers are non-transferable and can only be used be the person named on the voucher.

5.3. Lessons must be taken before the expiry date stated on the vouchers. The expiry date will be 3 months from the purchase or a pre arranged and agreeable date (e.g. a birthday or Christmas day), the same as normal advance payments.

5.4. Gift vouchers must be paid for by debit or credit card (3% handling fee for credit cards) either by telephone or in person at the ELITE Driving Instructor Training Ltd head office in Croydon.

5.5. Once payment has been received vouchers will be dispatched same day by Royal Mail 1st Class delivery.

5.6. Vouchers will only be issued to individuals residing in areas that ELITE have instructor coverage in at the time of order.

5.7. Booking of lessons are subject to instructor availability at time of booking.

5.8. If due to unforeseen circumstances there is no instructor availability at the time of booking then a full refund will be issued to the purchaser of the vouchers.

6. Other provisions

6.1. The instructor will provide the pupil with an ELITE Pupil Progress Record and Appointment Card. It is the pupils responsibility to ensure this be brought to every driving lesson so that a record of payment, balance of advance payments, and confirmation of delivery of lessons can be documented to safeguard your and the instructor's interest. This record will also contain confirmation of these terms and conditions and will be signed as accepted on the pupil's first driving lesson.

6.2. All driving instructors have to abide by the DSA Driving Instructors Code of Practice. This can be obtained from any Theory or Practical Test Centre. For more info, visit http://www.2pass.co.uk/code.htm.

6.3. The instructor has the right to withdraw a car from a test without prior notice if in their professional opinion the pupil has not reached a satisfactory test standard. There is no guarantee from the instructor that a pupil will reach test standard or pass the test, although every possible effort will be made in the pupil's interest in accordance with the DSA Driving Instructors Code of Practice.

6.4. The instructor has the right to terminate any lesson if, in their opinion, their safety, the pupil's safety, or the safety of the public is in any way under threat due to the pupil's nature, attitude, demeanour or driving ability.

7. Complaints procedure

7.1. If there is a dispute, in the first instance the matter should be resolved directly between the pupil and instructor. If the matter can not be resolved between the pupil and instructor then a complaint should be made in writing to:

7.2. Your complaint will be acknowledged within 3 working days, and following investigation, a satisfactory outcome or decision on how to resolve the dispute reached, normally within 28 days.

7.3. All Approved Driving Instructors are regulated and governed by the DSA (Driving Standards Agency) and any unresolved disputes with an individual instructor can be referred to the DSA customer services:

7.4. To provide protection for the consumer ELITE Driving Instructor Training Ltd operate under the strict guidelines laid out by the Safebuy. SafeBuy will act as mediators, at no charge to either party, in the event of a dispute between the retailer and consumer which cannot be resolved in a timely manner.

8. Data protection and privacy notice

8.1. ELITE Driving Instructor Training Ltd are exempt from notification for the purposes of the Data Protection Act as the company only holds basic personal information for the purpose of providing services, advertising and marketing activity directly related to driving tuition, and will not share personal information with any third party business or individual.
